Constitutional Council Censures Ban on Social Media for Under-15s

The Constitutional Council has censured the law prohibiting access to social media for minors under the age of 15 in France. Adopted by Parliament on July 21 with 279 votes in favor and 81 against, the law was set to come into effect in September. The Council ruled that this law imposed a disproportionate restriction on freedom of expression and communication. The Council members emphasized that the ban applied to platforms like TikTok and Instagram without distinguishing the risks to the health and safety of minors. They also noted the lack of consideration for age, family situation, and the level of maturity of minors. Furthermore, the law mandated age verification that did not ensure the protection of personal data. This decision comes amid a global debate on the protection of minors online. The President had made this ban a priority, but it remains to be seen whether a new text will be proposed to better meet constitutional requirements.
